01Who these terms are with

This website is operated by Karamation ("we", "us", "our"), a sole proprietorship providing custom CRM systems, business automation, AI solutions, integrations, dashboards and related software services. "You" means anyone accessing or using this website.

02Accepting these terms

By using this website you agree to these terms. If you don't agree with them, please don't use the site. If you're accepting on behalf of a company or other organisation, you confirm you're authorised to do so.

03What this website is

The site exists to describe what we do and let you try demonstrations of the kinds of systems we build. The content is general information about our services. It is not an offer capable of acceptance, and nothing on the site creates a contract between us.

We work to keep the content accurate and current, but we don't warrant that it is complete, error-free or up to date at any given moment.

04The interactive demos

The demos on our demos page are simulations. They run entirely in your browser and use invented sample data. Company names, contact names, deal values, scores, response times and metrics shown in them are illustrative inventions and do not represent real clients, real results or a commitment about what your system would produce.

The demos are provided "as is" for illustration only. They are not the software we would deliver, they are not connected to any live system, and nothing you enter into them is transmitted to us, stored or acted upon.

05Calculators and figures

The efficiency calculator and any other figures on the site produce rough estimates based on the assumptions you enter and simplified general assumptions of our own — including a fixed number of working weeks and an assumed recovery rate. They are a conversation starter, not a forecast, a valuation, a guarantee of savings or a projection of return on investment.

Actual outcomes depend on your specific processes, data quality, systems, people and circumstances. Don't make a financial or business decision on the strength of a number this website generated. Any savings estimate we stand behind will come from a completed audit and be given to you in writing.

06Not professional advice

Nothing on this website is legal, financial, tax, accounting or other professional advice, and it isn't a substitute for advice from a qualified professional who knows your situation.

07Enquiries, quotes and contracts

• Submitting the contact form or otherwise contacting us is free and places you under no obligation.
• Our reply, and any audit findings or indicative pricing we share, is an invitation to discuss work — not a binding offer, unless we clearly say otherwise in writing.
• Timelines and prices mentioned on this site are indicative ranges based on typical projects. Your project may differ.
• We are only engaged once we both sign a written service agreement. That agreement — covering scope, price, timelines, payment terms, ownership of deliverables, confidentiality, data processing, warranties and termination — governs the work and takes precedence over these terms and over anything on this website if they conflict.
• We may decline any enquiry or project at our discretion.

08Intellectual property

The content of this website — text, layout, design, graphics, the Karamation name and logo, and the demo code — belongs to us or our licensors and is protected by copyright and other laws.

You may view the site and print or download extracts for your own internal, non-commercial use in evaluating our services. You may not otherwise copy, republish, sell, adapt, redistribute or use our content or branding commercially without our written permission.

This clause is about the website. Ownership of anything we build for a client is dealt with in the service agreement for that project — where our standard position is that the client owns the delivered work.

09Acceptable use

You agree not to:

• Use the site unlawfully, fraudulently, or for any harmful purpose.
• Attempt to gain unauthorised access to the site, its host or any connected system.
• Introduce malware, or interfere with the site's operation or availability.
• Scrape, harvest or systematically extract content or contact details from the site, or use it to send spam.
• Submit false, abusive or misleading information through the contact form, or submit anyone else's personal information without their permission.
• Remove or obscure any copyright or proprietary notice.

10Third-party links and services

Where we link to another website, it's for convenience. We don't control those sites, we don't endorse their content, and we aren't responsible for them. The same applies to third-party services referenced on the site. Their own terms and privacy policies apply when you use them.

11Availability of the site

We aim to keep the site available but don't guarantee uninterrupted or error-free access. We may change, suspend, restrict or withdraw all or part of it — including any demo — at any time without notice, and we're not liable to you if we do.

12Liability

To the fullest extent permitted by law, and except for liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Protection Act, 2008 where it applies to you:

• The website and demos are provided "as is" and "as available", without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill, anticipated savings or data, arising from your use of this website.
• We are not liable for any decision you make in reliance on figures generated by the calculator or on the illustrative content of the demos.
• Where liability cannot be excluded, our total liability arising from your use of this website is limited to R1,000.

This clause applies to the website. Liability for paid project work is governed by the service agreement for that project.

If you are a consumer, nothing in these terms affects statutory rights you have that cannot be excluded or limited by agreement.

13Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms or your unlawful use of this website.

14Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

15Changes to these terms

We may update these terms from time to time. The version published here when you use the site is the version that applies, and the date at the top shows when it was last changed. Continuing to use the site after a change means you accept the updated terms.

16Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them. If any provision is found unenforceable, the rest remains in force.
